Chimel v. California Supreme Court Case, Arguments, Impact

In Chimel v. California (1969) the Supreme Court ruled that an arrest warrant did not give officers the opportunity to search the arrestees entire property. Under the Fourth Amendment, officers are required to obtain a search warrant specifically for that purpose, even if they have a warrant for arrest. Fast Facts: Chimel v. Facts of the Case On September 13, 1965, three officers approached Ted Chimels house with a warrant for his arrest. Chimel’s wife answered the door and let the officers into their home where they could wait until Chimel returned. When he returned, the officers handed him the arrest warrant and asked to â€Å"look around.† Chimel protested but the officers insisted that the arrest warrant gave them the authority to do so. The officers proceeded to search every room of the house. In two rooms, they instructed Chimel’s wife to open drawers. They seized items that they believed related to the case. In court, Chimel’s attorney argued that the arrest warrant was invalid and the warrantless search of Chimel’s home violated his Fourth Amendment right. The lower courts and the appeals courts found that the warrantless search was â€Å"incident to the arrest† which was based on good faith. The Supreme Court granted a writ of certiorari. Constitutional Issue Is an arrest warrant sufficient justification for officers to search a house? Under the Fourth Amendment, do officers need to get a separate search warrant to search the area around someone when placed under arrest? The Arguments Attorneys on behalf of the State of California argued that the officers correctly applied the Harris-Rabinowitz rule, a generally applied search and seizure doctrine formed from U.S. v. Rabinowitz and U.S. v. Harris. Together the majority opinions in those cases suggested that officers could conduct searches outside of the arrestee. In Rabinowitz, for example, the officers arrested a person in a one-room office and searched the entire room, including the contents of drawers. In each case, the Court upheld the officer’s ability to search the place where the arrest was made and seize anything connected to the crime. Chimel’s attorney argued that the search violated Chimel’s Fourth Amendment protections because it was based on an arrest warrant and not a search warrant. The officers had plenty of time to get a separate search warrant. They waited several days before acting on the arrest warrant. Majority Opinion In a 7-2 decision, Justice Potter Stewart delivered the opinion of the Court. The search of Chimels home was not incident to the arrest. The Supreme Court rejected the Harris-Rabinowitz rule as a violation of the fundamental intent of the Fourth Amendment. According to the majority, officers violated Chimels Fourth Amendment protections against illegal searches and seizures when they went room by room, searching his residence without a valid search warrant. Any search should have been more limited. For example, searching the subject of the arrest for weapons that might be used to get free from an arrest is reasonable. Justice Stewart wrote: There is ample justification, therefore, for a search of the arrestees person and the area within his immediate control—construing that phrase to mean the area from within which he might gain possession of a weapon or destructible evidence. However, Justice Stewart wrote, any further search infringes upon the Fourth Amendment. Officers must always take circumstances and the total atmosphere of the case into account but within the limits of the Fourth Amendment. The Fourth Amendment was ratified to protect members of the colonies from the warrantless searches they had experienced under British rule, according to the Justices. The probable cause requirement ensured oversight and aimed to curb police abuse of power. Allowing officers to search without probable cause because they have a search warrant defeats the purpose of the Fourth Amendment. Dissenting Opinion Justices White and Black dissented. They argued that the officers did not violate Chimels Fourth Amendment protections when they searched his home after arresting him. The Justices were concerned that the majority opinion prevented police officers from conducting an emergency search. If police were to arrest someone, leave, and return with a search warrant, they would risk losing the evidence or collecting evidence that had been altered. An arrest creates exigent circumstances, which means that the arrest creates a situation where a reasonable person would believe that immediate action needs to be taken. In addition, the Justices argued that a remedy to an unreasonable search is quickly available to the defendant. After an arrest, the defendant has access to an attorney and judge which is satisfactory opportunity to dispute the issues of probable cause shortly thereafter. Impact In their dissenting opinion, Justices White and Black noted that the term incident to arrest had been narrowed and expanded four times over the course of 50 years. Chimel v. California became the fifth change. Overturning the Harris-Rabinowitz rule, the case limited incident to arrest to the area surrounding the person under arrest, to ensure that the person could not use a concealed weapon on the officers. All other searches require a search warrant. The case upheld the exclusionary rule in Mapp v. Ohio which was both recent (1961) and controversial. Police power to search during an arrest was revised once more in the 1990s when the court ruled that officers may make a protective sweep of the area if they reasonably believe that a dangerous person might be hiding nearby. Also, computers furnish a lot of necessary access to information such as news and emails. Moreover, people use computers to keep in touch with entertainment, looking for friends; or watch Glee comedy and America’s Next Top Model shows. On the other hand, in reality, people sometimes abuse computers. Playing games on computer do not have benefit to adults and children; it wills a cause bad effect on people such as eye strains, wrist, neck and back pains. People, who use computers too otten in a long time, should take a snort break atter 1 or 2 hours. Computer can affect our mental health with the large amount of bad knowledge on the Internet; especially children and teenagers. The Evolution of Black Hair free essay sample

Abstract African-American, or Black, hair is very diverse. It ranges from extremely thin and straight, to extremely thick and curly. Throughout history, it could be seen as a gift and a curse. Hair in previous and modern times is seen as a sign of beauty, but all races are not always treated equally. Problems with identity and the struggle to conform caused many African-Americans to be ashamed of what they were born with. Even today, evidence of the struggles are still present. In the project we hope to learn how the views and opinions have changed throughout history. We would also like to educate others about African-American hair and inform them on the common misconceptions. Ms. Miller Social Studies 8 March 2012 The Evolution of African American Hair African-American hair has a history as long as the term itself. From desperate attempts to cope to an inability to maintain, Africans and African-Americans, when it came to hair, were seemingly â€Å"forced† into hiding or altering their hair to conform to what society saw, at the time, as â€Å"normal†. What made life that much easier at the time, made it a struggle to break away from that dependence or constant attempt to be normal or to fit in. In a world today where individuality is just beginning to be embraced, people must look back in history to see where some of the stereotypes and feelings come from, so that they may understand why people do the things that they do. The first African slaves were brought into Jamestown in 1619, but soon after, African language, culture, and grooming habits began to disappear. Without the privilege of access to hair grooming tools, items like butter, kerosene, and bacon grease were used as conditioners and cleaners (Naturallycurly. com). These products were usually excess items that the slave owner, or master, didn’t use in his home. Pictures from this period would depict female Africans or African-Americas with scarves or cloth on their heads. Several sources say that they were symbols of enslavement and subordination. In fact, there were laws passed in the South that said female slaves must wear the head wraps. Other sources say that it was a misconstrued sign of rebellion, adapted from African culture (The African American Womans Headwrap: Unwinding the Symbols). While the head wraps protected the hair from the elements and protected them from lice, they bonded them to slavery. With nothing to care for their hair, they covered it up to hide it. The pressure to change didn’t stop there. Slaves with lighter skin and straighter hair were worth more at auctions. This led many to believe that the slaves with darker skin and curlier hair were less attractive and worth less. Although several years after the end of slavery, skin bleaching products were released. African-Americans, who styled their hair like, or closely resembled, white people, were respected even though they were not seen as equals. The end of slavery bought new challenges for everyone, and the same feelings and views associated with African or African-American people before, were still there (A Look Back at the Black Hair Story). Hiding out of embarrassment did not last too long. Garrett Augustus Morgan, the child of two former slaves, noticed that certain chemicals he used at the clothing factory he worked at could not only straighten fabric, but also hair (Taylor). After his first successful live experiments, first on the naturally curly fur of an Airedale dog and later on himself, he opened the G. A. Morgan Hair Refining Company in 1913 and began to straighten hair in his home workshop. The chemicals he used were very strong could never touch human skin. The alkaline and lye chemical mixture strips the hair of proteins and removes the curl permanently. In order to maintain the chemically straightened hair, the relaxer would have to be reapplied every six weeks, or every time the curly hair began to grow back. Stemming from the time of slavery, many African-Americans found it hard to manage their hair. Relaxers supposedly made their hair more â€Å"manageable† and caused them to be widely accepted. Years later, African-Americans who used relaxers saw the harmful effects that lye had on their hair. It could cause burns, hair thinning, and hair and skin loss. No-lye relaxers were made to reduce those results. In relaxers today, chemicals a lot less than harmful lye, such as potassium hydroxide and lithium hydroxide are used. Despite the harmful effects, African-American women who styled their hair like white women, whether it was with chemical straighteners or straightening combs, were seen as â€Å"well-adjusted† and more widely accepted in the white community although African-Americans even though blacks were not seen as equals (Little-Known Black History Fact: Hair Relaxer). Years later, in the twentieth century, the nineteen-sixties were a time of change or transition. In the early part of the decade, the Black community still tried hard to be accepted, or to feel normal. The surge of Civil Rights and â€Å"Black power† fuelled a sort of rebellion for many Black people. Relaxers fell out of style, and many African-American leaders urged people to return to their â€Å"roots†. Black pride was centered on political and social issues, but it could be evident in appearance. Many African-American men and women began to â€Å"go natural† and wear their hair in large afros. The afro was not an only a political symbol, but also a huge milestone in fashion. Soon after this style came to be, many white people began to copy the style as well. The tables had turned. Instead of looking for normalcy or acceptance in the way the blacks wore their hair, it was the other way around. This marked a huge step in the acceptance of African-American independence and their hair (Civil Rights New Zealand). People from all races began to go natural, but the question is â€Å"what is natural hair? † The answer is clear and simple. Whenever a person is born their hair is natural. Natural hair can have no curl, a slight curl, or be completely curly as long as the texture it is not chemically altered. After Garret Morgan invented the relaxer, several African-Americans, men and women, straightened their hair permanently to be accepted by the white community. After their hair was previously straightened, it was no longer natural. Even though they had a relaxer applied, their hair would always grow back curly even if the hair that was relaxed never did. So basically, if they stopped getting a relaxer, the straight hair would remain, but their naturally curly hair would grow from the roots. Many, though, did not stop there. Several African-Americans continued to get a relaxer to maintain the straighter look. The Civil Rights and Black Power era caused many African-Americans to stop getting relaxers, or to â€Å"go natural†. Whenever they felt they were ready, they would cut of the straight, relaxed and let the rest of the curly hair grow. At the time black natural hair was a trend, a large part of fashion during the time, but like every trend it had to come to an end (The Truth About Hair Relaxers). Hair extensions have had a checkered history in the African-American community. Women of all races have used wigs, weaves, and other types of extensions, but there is sometimes a certain stigma tied with them and African-American women. Hair weaves are applied by braiding the hair and long wefts or tracks of hair are sewn with needle and thread to the braid. The hair can be human, synthetic, long, short, straight, or curly. Most of the controversy comes from this. Some women African-American women wear weaves all the time so that they can look more professional and others wear them for convenience. Some will even wear them for the transitioning to natural period. Many women are penalized for wearing weaves or extensions of any kind because others see them as fake. Weaves or extensions are one of the most common forms of hair styling seen in the African-American, or Black, community, almost tying with braiding with extensions (Fashion-Era. com). Now that African Americans have gone through these changes and experiences through the years how has it changed since today’s era? The twenty-first century brought new changes to the way the African-American hair was viewed. The Civil Rights era was a huge leap towards equality, and even though people of all races still fight towards equality every day, it was an important part in America’s history. However, history does tend to repeat itself. The relaxer made its way back into African-American homes. Many people believed that natural hair was, once again, unmanageable and unprofessional. Also, pressure from friends of other races to be more â€Å"normal† could push African-American women to straighten their hair. The end of the decade, however, brought new changes. More and more people are â€Å"going natural†, and proving the stereotypes wrong. This will produce a whole new generation of African-American females with new feelings and ideas about their own hair. America was built on the principles of opportunities and freedom from persecution. Anyone who knows American history knows it was never that easy. Even today, equality in all aspects of life is a goal we will always try to obtain. The past is full of memories, some that we may not remember, ones that we cannot forget, and even those that we are ashamed of, but in order to learn to make a better present and promising future, we must remember the past (Black Hair). Conclusion Learning about the history of African-American hair and how it has evolved was a tough, but interesting process. The history was filled with struggle. The struggle to become what was believed to be normal, and the struggle to break away from it. We were surprised to find out what products were used during the slave era and also that many other races began to copy the afro during the Black Power Movement. We were amazed at the transformation African-American hair has gone through throughout the years. We hope that our project will enlighten others, just as it has enlightened us.

Midsummer Nights Dream And Love What is True Love? The overriding theme of the play "A Midsummer Night's Dream" by William Shakespeare deals with the nature of love. Though true love seems to be held up as an ideal, false love is mostly what we are shown. Underneath his frantic comedy, Shakespeare seems to be asking the questions all lovers ask in the midst of their confusion: How do we know when love is real? How can we trust ourselves that love is real when we are so easily swayed by passion and romantic conventions? Some readers may sense bitterness behind the comedy, but will probably also recognize the truth behind Shakespeare's satire. Often, love leads us down blind alleys and makes us do things we regret later. The lovers within the scene, especially the men, are made to seem rather shallow. They change the objects of their affections, all the time swearing eternal love to one or the other. In this scene Shakespeare presents the idea that both false love and true love can prevail.. Throughout Act III Scene II, many conflicts arise. However, the main conflict within the scene is the confusion the lovers face when their perceptions are altered. This confusion enhances the central theme of true love versus false love. There are many aspects of the play that deal with this central theme, but it is most prevalent within this scene. The chaos reaches a climax causing great disruption among the lovers. However, the turmoil is eventually resolved by the character who is originally responsible for the confusion, Puck. Puck causes the disruption initially, when he intervenes in the lovers' business. Jester and jokester, Puck, otherwise known as Robin Goodfellow, is like a wild, untamed member of the fairy clan. Though fairy king Oberon tells him they are "spirits of another sort," Puck, with his connection to English legend and folklore, seems related to a slightly more dangerous kind of sprite. Not that he is truly malevolent, but his tricks make people uncomfortable. However, they don't seem to do any permanent damage. He casts an ironic eye on humanity. Thinking of people as fools, he loves to make fools of them. He expresses this idea when he states "What fools these mortals be..." But laughter, not tears, is his aim. With his quickness, ventriloquism, and shape-changing ability, he clearly has magic fairy powers of his own. Meddling in the affairs of lovers and administering Cupid's love juice, clearly presents Shakespeare's views on the nature of love. Puck's mischievous ways may allow him to meddle within the affairs of the lovers, however, does this interference do more harm than good? This scene begins with Oberon encountering Puck in the middle of the woods. Puck, very excited, explains his actions. He tells Oberon how he caused Titania to fall in love with Bottom, who now has a donkey head. Puck also tells him that the Athenians had been placed under the spell causing them to fall magically in love. Oberon is very pleased with Puck's efforts, and agrees that the situation turned out better than expected. However, Oberon soon realizes Puck had made a mistake by causing the Athenian to fall in love with the wrong person. Oberon admonishes Puck for his mistake. Because of Puck, true love has been turned, "and not a false turned true." Puck replies that those are the rules of fate. For every man holding true love, a million fail, breaking their oaths again and again. This was not exactly what Oberon had in mind, he was hoping to remedy a situation, not make it worse. Puck always tries to throw something extra into the situation; he enjoys complications. "Then fate o'er-rules, that, one man holding troth, A million fail, confounding oath on oath." By saying this, Puck makes it clear that the odds on finding true love are a million to one. It becomes clear that humans are going to need very accurate eyes to be able to see love clearly. Puck's mischief turns a supposedly true love inside out. However, this is not necessarily a bad thing. This mistake is used for the benefit of both Helena and Demetrius. Puck uses his magic to unite the lovers under a cloud of false love. This aspect of false love is what holds the lovers together, proving that false love can be just as strong as true love. The other aspect of the nature of love is that true love triumphs. This is proven through the characters Lysander and Hermia. Puck

With a double major, you're earning just one bachelor’s degree (i.e., one diploma) with specializations in two fields. However, with a dual degree, you’re earning two separate degrees/diplomas (which could be two bachelor’s degrees, a bachelor’s and a master’s, etc.) in two distinct fields. Typically, a double major means you’ll be studying two fields that are based in the same school and that’ll earn you the same type of degree, such as a Bachelor of Arts (BA), a Bachelor of Science (BS), or a Bachelor of Fine Arts (BFA). By contrast, a dual degree usually means you’ll be studying two unique fields that are based in two different schools and that’ll earn you two different types of degrees (e.g., a BS and a BFA). In my case, I double majored in English and East Asian Languages and Cultures (EALC) at USC. This means I earned just one college degree: a Bachelor of Arts with concentrations in English and EALC. Because classes for the English and EALC majors were both housed in the College of Letters, Arts, and Sciences (and both majors led to a BA), I was able to study the two fields under the same degree. That said, if I’d wanted to study a much more different combination of fields, such as English and architecture (which are housed in two different schools at USC), I'd needed to have studied the fields as two separate degrees, which would have earned me a BA in English and a Bachelor of Architecture. Now that you understand this basic difference, let’s take a look at the main qualities that define a dual degree and a double major. With a dual degree, you'll get two diplomas when you graduate from college. What Is a Dual Degree? A dual degree (also called a double degree) is when a student studies two different fields at the same time in order to earn two separate degrees. Depending on the university, this could be a wide combination of degrees, such as two types of bachelor’s degrees, a bachelor’s and a master's, or two master’s/professional degrees. Each degree corresponds to one of the fields in which you’re specializing. For instance, at the University of Michigan, undergraduate students can pursue a dual degree by earning a Bachelor of Business Administration (BBA) at the Ross School of Business and a BA, BS, BFA, etc., at another school within UM. Universities that offer dual degree programs often require students to apply and get accepted to the two schools at which the fields are housed. Because a dual degree requires students to simultaneously complete the requirements for two different degrees, it typically takes more time (more than four years or four years plus summer classes) than a regular undergraduate program does. As with any degree, you must complete all basic requirements (including general education courses and major courses) for both degrees in order to earn them. Columbia’s BA/MPA dual degree program, for example, takes a total of five years to complete- but by the end of this, you’ll be rewarded with both a bachelor’s degree and a master’s degree. This extra time required for a dual degree naturally means that students who are pursuing one will likely have to pay more in tuition, housing, etc. Nevertheless, you’ll save money (and time!) doing a dual degree than if you had pursued the two degrees separately or at different times. A double major allows you to study two fields and get just one degree. What Is a Double Major? You’ve probably met or heard of college students doing a double major. First of all some concepts to clarify the topic, are sexism and advertising. Sexism is defined as: Discrimination based on gender, especially discrimination against women; Attitudes, conditions, or behaviors that promote stereotyping of social roles based on gender. Advertising can be defined as: the activity or profession of producing advertisements for commercial products or services; Advertising is attempting to influence the buying behavior of customers or clients by providing a persuasive selling message about a product and/or service. (Oxford English dictionary, 6th edition). In old advertisements we could see an explicitly how women were battered by their husbands, it was appreciated as a normal thing, even being promoted by advertising; the men had the right to abuse their wives in order to teach them where was their place. Although today we can see some ads talking about respecting women and condemning the abuse against them, the advertising still mistreats women in many aspects and affects their lives and behavior. Woman is seen as a sex object or decorative object. The ads we can see today in the street, television, Internet, radio or print media show us the view that in advertising the value of women is her body and body image, rather than their ability to promote a service or product with ideas and good arguments. Some examples are beer ads that show beautiful and scantily clad women to catch consumers attention. In this case we can not only appreciate the use of women as objects but also the prejudice of mens products in this case the beer is seen as a product consumed only by men, as also happens with cars and cars products. This creates in man the idea of women as a trophy and he is able to buy and use certain products or services to achieve having a beautiful woman by his side. Through many ads we see how the image of a beautiful woman is used, without any justification, since it is not related to the product being promoted and there is no reason that joins the use or purpose of the product with that image. The meaning of that image does not represent the meaning of a certain service, and neither is not part of what the user searches, nor part of the functions that service provides. It seems that the female body is seen as a decoration in advertising, it is seen as an ornament as the background or the colors used in an advertisement. Rather than consumers of those products women are seen as a striking accompaniment to show the product or service. Advertising creates in women a feeling of discomfort and dissatisfaction with their bodies and possessing material goods. Through ads we can see beautiful women who have greater opportunities, get what they want easily, appear to be most desired and cherished and have a happier and easier life. That is why this type of advertising is of great importance not only in the consumption habits of women, but also in their thinking, as most are influenced by this endless search for beauty whether through diet products, cosmetics, fashionable clothes or Through cosmetic surgery to alter her physique according to standards of beauty established by magazines and advertisements of all kinds. These standards of beauty are deeply rooted in our society and women of all ages are influenced by them, besides the advertising and the market have been responsible for creating products for all ages, so every woman can have a need and a product to make she think in a feeling of satisfaction when buying this product . For example if youre a teenager you need products against acne and if youre older you need products against wrinkles. These products create in women the idea of material needs that they really do not need. Then every day there are new products been created, products that are not really primordial and that in most of the cases do not achieve what they are promising to the consumers. Todays ads promote the idea that women are inferior, less capable or less intelligent. todays advertising promotes the idea that women are not capable of performing certain activities due just to the fact that they are women, or if they do, they are responsible of accidents because they are not capable or have a lower level of intelligence or simply because it is an activity that only men can do well. One example is an advertisement that shows a beautiful woman who carelessly crashes her car boot to another at the back, then is deceived by a man who says to be the owner of the other car, asking for her phone number to a supposed reckoning, the advertisement hints a possible meeting between the characters, and a mans double intention of seducing the beautiful woman. Just as there are activities which by their difficulty can only be performed by men, there are activities that are mandatory tasks for women such as child care, housework, etc. That is why cleaning products and domestic products are promoted by housewives and men in any case are users of these products. This is complemented by the idea of a chauvinist society, not only created by men, but also being promoted by the women themselves, as they have the image of themselves as responsible to do the laundry, the house cleaning, the cooking, etc. Ads are cooperating in this mentality, with women being the target of cleaning products. In conclusion, I could say that there are many disadvantages in the use of sexism in advertising and it affects mens and womens minds, especially womens, who have been and are, exposed everyday to ideas and advertising strategies to control their behavior, thoughts, culture, etc. Some of these ideas and advertising strategies can cause damage not only in women lives but also in our society and personal life style. In my opinion advertising and todays society are responsible of many ideas an stereotypes that influence women and in some how cause them feelings like frustration, dissatisfaction and anxiety about their bodies, clothes, material goods, behavior, etc. Also I think that they can cause great damage in people who are more likely to be influenced by ideas and stereotypes that Advertising offers today, like adolescents who are bombed with promises of beauty that would bring them self-confidence, happiness, love, friendship, admiration, fame, and a social status that would be respected by their peers. Most normal individuals in the modern world would assume that all books written, not published, by man are based on either a portion of the author’s imagination, an event (biased or non-biased) in either history or during the life of the author, a straight-out autobiography, or a generalized biography of another person they once knew. However, this philosophical novel fits none of the descriptions above. The book is actually an in-depth recording of a philosophy contest between Plato’s teacher Socrates and several other great philosophers. What is significant about this contest is that, in it, Socrates describes his personal view of a â€Å"perfect world,† and why justice is so important in the process of creating a civilized world.The novel was completed in 370 B.C., and it describes a strong debate between Socrates and five other speakers. The two main arguments that he illustrates in this novel are that a ruler cannot obtain more power than the state, and that a philosopher is best suited to rule a nation since he has the ability to maintain this balance. Also, Socrates claims that only the philosopher has traveled beyond the â€Å"cave† of worldly desires and temptations to discover what justice really is. Socrates’ first major argument is with Thrasymachus in Book I. The current debate lies on the pure definition of justice. Thrasymachus claims that there is only one principle of justice: the interest of the more dominant force. Socrates counters this argument by using the phrase â€Å"the stronger.† He claims that the ruler of a nation will not be aided, but harmed, by an unintentional command, in the long run. Socrates then builds his argument gradually by stating that the good and just man looks out for the interest of the weaker, and not for himself. Thrasymachus tries to counter Socrates’s argument by vaguely proclaiming that injustice is more gainful than justice.However, Socrates bravely explains that the just man will live happily because he has a just soul, and the man with the unjust soul lives in poverty; therefore, injustice can never be greater than justice. At this point in the novel I saw Thrasymachus’s flaw and also the reason why Socrates has silenced Thrasymachus. Injustice, in my opinion, may be better as a short-term plan for pleasure, but in the long run the unjust man will be condemned by just men of his evil deeds, thus leading to his downf... ...nally, Socrates points out that, in his perfect State, philosophers will always have the advantage over other types of rulers because they have wisdom and knowledge, which gives them the ability to govern justly and wisely. In my opinion, Socrates’s perfect State sounded plenty like the scenario progressing in the debate. Socrates, since he is a great philosopher, had the advantage over everyone because he was wise and intelligent in his arguments; therefore he obviously knew more about justice than anyone else. So, in conclusion, Socrates won the debate on the definition of justice. The reason for this is because Socrates, as stated before, had the wisdom and knowledge to analyze, in the most descriptive way, what justice really is. Glaucon and the others lacked what Socrates had, and so they could not support their arguments as well as Socrates could. I really liked this novel a lot because I am a lover of philosophy and understanding. However, I must admit that some of Socrates’s arguments were redundant and besides the point. But other than this crucial flaw, the book showed great insight, and Socrates created a vivid description about what justice means to the modern world.

Although it currently enjoys high profit margins and has made significant improvements in its existing brand performance, its growth has plateaued. NM believes that there is only limited potential for growth of its current full-line stores while maintaining its exclusivity. As a result, it is considering other growth opportunities. The strategic goal is to increase its revenue by at least $150 million over the next 6 years while maintaining its attractive profit margins of 15%. Of the number of possible growth options, we recommend NM to grow via the Galleries concept. We believe that this concept is in line with its current core strength of creating and maintaining customer loyalty with luxury customers. Moreover, it can benefit from its existing customer base, efficient sales force and brand name. However, NM needs to carefully choose the gallery locations since there are some risks associated with direct competition with existing leaders and confusion among its current customers about the shift in brand-focus. NM’s positioning is to attract the affluent consumer, with a household income of over $100,000, by providing high-end luxury lines of women’s and men’s apparel, Jewelry, Cosmetics/fragrances, Gifts, Women’s shoes and Accessories. The core competencies that NM engages to differentiate itself in the marketplace are exclusive high-end designer merchandise, personable, knowledgeable and highly competent sales staff that aims at not only achieving a high level of customer satisfaction, but also establishing themselves as a personal shopper for the customer. The sales staff is cross-trained in multiple departments, and is empowered to build long term relationships with their customers. This enables NM to provide a customized and personal experience for its clientele, thus encouraging them to be repeat customers and increase their spend at NM. NM utilizes another core-competency of catalogs for direct marketing, thus creating avenues to increase spend by the customers. One of the differentiators for NM, an un-imitable competency that creates barriers of entry is the customer based marketing programs, and events. The InCircle program is targeted to enhance customer relationships and brand loyalty. Special events and incentives are creating for the â€Å"creme-de-la-creme† spenders via the InCircle program that provides these customers to become repeat consumers via exquisite rewards programs and one-on-one customer service. Nordstrom on the other hand had similar merchandise portfolio as NM, and was known for the level of personal customer attention and service it provided by building key relationships NM on the other hand provided multiple competencies that included specialty store variety (for specific designers) and department store scale and service. Quantitative Analysis of the Galleries Concept We performed a quantitative analysis to evaluate the Galleries concept. We made some key assumptions for the analysis. First, the revenue per sq. ft. or the three lines: fashion jewelry, precious jewelry and gifts would be equal to the current NM revenues in these departments. Second, the annual percentage revenue growth for Galleria would be equal to NM’s current annual revenue growth of 7%. Third, the allocation of space within the 10,000 sq. ft. galleria would be allocated to the existing ratios within the three departments. Using these assumptions, as shown in Exhibit a, we calculated the revenue per sq. ft. for the three lines. Using these values, we computed the expected revenue (base year) for one galleria (Exhibit b). We next constructed the pro-forma (Exhibit b) for one galleria for the next 6 years. We assumed that the revenue growth would be the same (7%), the gross margin and hence the COGS would be constant (56% which is the current weighted COGS for these three department). As seen in the pro-forma, we estimate each galleria will have revenues of $10. 8 million and Cash-flow (assuming EBT = EBTDA) of $2. 1 million by year 6. Using Present Value of the Cash flows (assumed equal to EBIT) at 15% discount rate, we estimate the payback period for each galleria on the initial investment of $5 million to be 5 years (2003 assuming base year is 1998). With additional revenue per galleria in Year 6 estimated at $10. 8 million, to achieve a financial goal of $200 million in additional revenue from the galleries by Year 6, NM would need to open 19 (200/10. ) galleries. This would require an overall investment of about $95 million in capital in the current year. The quantitative analysis indicate that if the three constituent departments of the galleries can perform at least at par with current levels (mainly in terms of revenue per sq. ft. and gross margins) , NM is very likely to fulfill the goal of $200 million in surplus revenue growth by year 6. In fact, since the payback period (at 15% discount rate) is 5 years, the IRR return from the investment is expected to be more than the required 15%. Thus the quantitative analysis is definitely is in favor of the galleries concept. Qualitative Analysis of the Galleries Concept The Galleries concept is to aimed to expand the per-customer spend of the target affluent consumer, by providing specialty stores for specific merchandise category. One of the viable options is to consider a Gallery which includes the departments that provide the highest revenue per sq. ft. amely Precious jewelry, fashion jewelry and Gifts, again targeting the same affluent customer segment. This concept makes sense for NM since it can leverage from its current strengths – loyalty program, dedicated and knowledgeable staff, and its existing brand value. Moreover, expanding the gallery concept in US where it already has an established brand name and elite-status makes perfect sense. However, as discussed before, the Jewelry and Gifts gallery concept would end up going head-to-head with a Tiffany’s store. Therefore NM needs to address the following risks for ensuring significant market share capture. First, considering that the flagship Tiffany’s store has a sales/sq ft ratio of over $3000 [Exhibit 1 and 4], NM needs to either increase the retail space for precious jewelry to improve from the overall expected $721 / sq. ft revenue (this is because precious jewelry in current NM stores earn a much higher $1669/ sq ft), or decrease the store gross selling space for the gallery. Second, expanding the number of Galleries excessively might rebrand NM in the minds of customers as jewelry focused company and might affect the sales of its other flagship products such as women’s apparel and shoes in original NM stores. Therefore, NM needs to be careful in choosing the locations of these new galleria stores and try to not choose locations where they currently exist. With regards to the locations of the new Gallery stores, we believe that NM needs to choose locations that are not competitively served (by Tiffany’s) in the Jewelry category, and also locations that do not have heavy overlap with its current locations. It is also important not to deviate from the target affluent consumer with high buying power index. Thus, we recommend the ollowing top 3 locations for NM to open the initial Gallery stores to ensure impactful market share capture. Based on how the galleries perform in these markets, NM can use the same criteria to open galleries in other markets. Seattle – Top most 1996 BPI; No Tiffany presence; some overlap with NM stores Cleveland – Ranked 2nd 1996 BPI; No Tiffany presence; some overlap with NM stores Sacramento – Ranked 3rd 1996 BPI; No Tiffany presence; hi gh overlap with NM stores Conclusion Based on the analysis of NM’s current positioning and its core competencies, we believe the Galleria concept presents a good growth opportunity for NM. Quantitatively, the concept has potential to fulfill both of NM’s current goals: revenue growth ($150-$200 million revenue growth over 6 years) and profit margin (Payback period for initial investment is under 6 years at desired 15% cost of capital). However, NM needs to be careful in choosing the locations for two reasons: to avoid head-to-head competition with existing jewelers such as Tiffany’s and to avoid confusion of its brand focus in the minds of its existing rich customer base.

How Principals Can Provide Teacher Support Having a supportive principal can make all the difference for a teacher. Teachers want to know that their principal has their best interests in mind. One of the main duties of a principal is to provide ongoing, collaborative teacher support. The relationship between a teacher and a principal has to be built on a foundation of trust. This type of relationship takes a lot of time to build. Principals must slowly cultivate these relationships while taking the time to get to know each teachers strength and weaknesses. The worst thing that a new principal can do is to go in and quickly make a lot of changes. This will assuredly turn a group of teachers against a principal quickly. A smart principal will initially make small changes, allow time for teachers to get to know them, and then gradually make larger, more meaningful changes over the course of time. It is important to note that any significant changes should be made only after seeking and considering input from teachers. Here, we examine ten suggestions for earning teacher trust and ultimately providing them with ongoing, collaborative teacher support. Allow Time for Peer Collaboration Teachers should be given time to work together in a collaborative effort. This collaboration will strengthen relationships among your faculty, provide new or struggling teachers with an outlet to gain valuable insight and advice, and allows teachers to share best practices and success stories. The principal becomes the driving force in this collaboration. They are the one who schedules the time to collaborate and sets the agenda for these times. Principals who reject the importance of peer collaboration are selling its value far short. Ask Questions and Seek Their Advice The principal is the primary decision maker in their building. This doesn’t mean that teachers shouldn’t be included in the decision-making process. Although a principal may have the final say, teachers should be given a platform to express their feelings or provide advice for the principal, especially when the issue will directly affect the teachers. A principal should use the resources at hand when making decisions. Teachers have brilliant ideas. By seeking their advice, they may challenge your thinking on an issue may validate that you are on the right track. Neither case is a terrible thing when making any decision. Have Their Back Teachers are people, and all people go through difficult times both personally and professionally at some point in their lives. When a teacher is going through a difficult situation personally (death, divorce, illness, etc.), a principal should give them 100% support at all times. A teacher going through a personal issue will appreciate any support their principal shows during this time. Sometimes this could be as simple as asking them how they are doing and sometimes it may be necessary to give them a few days off. Professionally you want to back a teacher as long as you believe they are effective, ethical, and moral. There are situations where you absolutely cannot support a teacher because the decision they made is ethically or morally wrong. In this case, do not skirt around the issue. Be up front with them and tell them that they messed up, and there is no way you can back them up based on their actions. Be Consistent Teachers hate it when principals are inconsistent especially when dealing with student discipline or parent situations. A principal should always try to be fair and consistent with their decision making. Teachers may not always agree with how you handle situations, but if you establish a pattern of consistency, then they will not complain too much. For example, if a 3rd-grade teacher sends a student to the office for being disrespectful in class, check your student discipline records to see how you have handled similar issues in the past. You do not want any teacher to feel like you play favorites. Conduct Meaningful Evaluations Teacher evaluations are meant to be tools that show a teacher where they are and to move them in a direction to maximize their overall effectiveness. Conducting meaningful evaluations takes a lot of time and time is not something a lot of principals have, therefore many principals neglect making the most out of their teacher evaluations. Providing effective teacher support requires constructive criticism at times. No teacher is perfect. There is always room for improvement in some area. A meaningful evaluation allows you the opportunity to be critical and to offer praise. It is a balance of both. A satisfactory evaluation cannot be given on a single classroom visit. It is a collaboration of information gathered through many visits that provide the most meaningful evaluations. Create a Teacher-Friendly Schedule Principals are typically responsible for creating their building’s daily schedule. This includes class schedules, teacher planning periods, and duties. If you want to make your teachers happy, minimize the time they need to be on duty. Teachers hate duties of any kind whether it is lunch duty, recess duty, bus duty, etc. If you can figure out a way to create a schedule in which they only have to cover a few duties a month, your teachers will love you. Encourage Them to Bring Problems to You Have an open door policy. The relationship between a teacher and principal should be strong enough that they can bring any problem or issue and trust that you are going to try your best to help them out confidentially. Often times you will find that teachers simply need someone to vent their frustrations to, so being a good listener is often all that is necessary. Other times you will have to tell the teacher that you need some time to think about the problem and then get back with them with some take it or leave it advice. Try not to force your opinion on the teacher. Give them options and explain where you are coming from. Tell them what decision you would make and why, but don’t hold it against them if they go with another option. Understand that every situation that is brought to you is unique and how you handle that situation depends on upon the situation itself. Get to Know Them There is a thin line between getting to know your teachers and being their best friends. As their leader, you want to build a trusting relationship without getting so close that it interferes when you have to make a tough decision. You want to build a balanced relationship between personal and professional, but you don’t want to tip it where it is more personal than professional. Take an active interest in their family, hobbies, and other interest. This will let them know that you care about them as individuals and not just as teachers. Offer Advice, Direction, or Assistance All principals should continuously offer their teachers advice, direction, or assistance. This is especially true for beginning teachers, but it is true for teachers throughout all levels of experience. The principal is the instructional leader, and providing advice, direction, or assistance is the primary job of a leader. This can be done through a variety of ways. Sometimes a principal can simply provide a teacher with verbal advice. Other times they may want to show the teacher by having them observe another teacher whose strengths are in an area where that teacher needs assistance. Providing the teacher with books and resources are another way to provide advice, direction, or assistance. Provide Applicable Professional Development All teachers are required to participate in professional development. However, teachers want these professional development opportunities to be applicable to their situation. No teacher wants to sit through eight hours of professional development that doesn’t directly apply to what their teaching or they will never use. This can fall back on the principal as they are often involved in the scheduling of professional development. Choose professional development opportunities that are going to benefit your teachers, not just ones that meet your minimum professional development criteria. Your teachers will appreciate you more, and your school will be better off in the long run because your teachers are learning new things that they can then apply to their daily classroom.

In Kurt Vonnegut, Jr.’s short story, Harrison Bergeron, everyone is assigned â€Å"handicaps† that make them equal to everyone else. These handicaps included wearing weights around the neck, wearing a mask to cover beauty, and having a device in the ear so thinking could not be overdone. â€Å"Nobody was smarter than anyone else; nobody was better looking than anyone else; nobody was stronger or quicker than anyone else. All this equality was due to the 211th, 212th, and 213th amendments that were added to the Constitution. † (Vonnegut 369) Harrison Bergeron is a valid representation of the potential control of a government and the repercussions a society could face if every individual were forced to be identical. The short story is based off of three characters: Hazel, George and Harrison Bergeron. George was forced to wear a device in his ear that prevented him from thinking too much since his intelligence level was above normal. Hazel, on the other hand, â€Å"had a perfectly average intelligence, which meant she couldn’t think about anything except in short burst.† (Vonnegut 370) Harrison was their son that was captured at the age of fourteen by the H-G government. Harrison was athletic and handsome. His handicaps included wearing headphones instead of an earpiece, spectacles that nearly made him blind, and about three hundred pounds of metal. â€Å"To offset his good looks he was forced to wear a red nose, shave off his eyebrows, and to cover his white teeth with black caps.† (Vonnegut 372) Hazel and George were watching television when news came on about Harrison Bergeron escaping from prison. The news cast told those watching that this man was extremely dangerous and flashed pictures of him upon the screen. George realized that it must be Harrison but the realization was quickly taken from his mind when the sound of a collision went off in his head. After George opened his eyes, the picture of Harrison was gone but he was actually shown on television yelling, â€Å"I am the Emperor!† Because of Harrison’s great strength and tall features everyone was cowering down to him, except one ballerina that stood up to be his empress. Harrison had ripped off all his handicaps and the handicaps from the empress and the  musicians. Harrison and his empress were dancing to the music that he forced the musicians to play, when â€Å"Diana Moon Glampers, the handicapper general, came into the studio with a double-barreled ten-gauge shotgun. She fired twice, and the Emperor and the Empress were dead before they hit the floor.† (Vonnegut 374) Shortly after, the Bergeron’s television had gone off. George leaves to get a beer and upon his return he sees that Hazel has been crying. George asks her why she has been crying but because she can only think in short burst she can’t remember why the tears were coming. Because of George and Hazel’s handicaps, they could not remember that Harrison was their son that had just been killed on the television. Due to everyone being forced to be equal to one other, the government made the people become stupid, slow, and even obeying the law because of fear of punishment. Harrison knew he was good looking, athletic and smart. When Harrison escaped from prison and disobeyed the law, it would be easier for him to rule over others because everyone else was still chained to the law. With his great strength and rebellion he became an â€Å"Emperor† for a short time. Foreshadowing was shown when Hazel and George talked about taking some weight off of George’s neck. George explains to Hazel â€Å"that if he tried to get away with it, then other people’d get away with it-and pretty soon we’d be right back to the dark ages again, with everybody competing against everyone else.† George asks Hazel what she thinks would happen to the society, Hazel replies, â€Å"Reckon it’d fall all apart.† (Vonnegut 371) The government knew that if people listened to Harrison that everyone would start disobeying the law, so they got rid of him. They could have also shot him because they got scared of what they could not control. By showing the killing on television, it showed the society what will happen if they start rebelling. A sedated society, that of which is handicapped, is much easier to control. I believe Harrison Bergeron shows what exactly it would be like for everyone to be equal. It also effectively represents the kind of control that a government would have over a society. If the government gives everyone equality and makes them â€Å"weak† it gives the government way more power than what they already have. At some point in time everyone has the thought of an equal society but we do not think of what it would take for that to happen. Harrison Bergeron shows what the consequences would be. I believe the fact that everyone is unique should be more appreciated rather than wanting to bechanged. If people were forced to be equal life would be the same for everyone and not as adventurous and fun. The problem with an equal society is that no one would be able to be their selves. In order for everyone to be equal, there would have to be some consequences for those who rebel against the law. Also, the handicaps would be necessary in order for everyone to be equal. This would give the government complete control over a society which could also cause problems. Harrison Bergeron is a vivid representation of the potential a government could have on a society, and the dangers of an equal society.
